Delaware Department of Insurance Steps In to Protect Patients Amid Rite Aid Closures

As Rite Aid closes pharmacy locations across Delaware due to its Chapter 11 bankruptcy filing, the Delaware Department of Insurance is taking steps to protect patient access to medications.


Emergency Prescription Refills Now Required

In response, Delaware Insurance Commissioner Trinidad Navarro has issued a bulletin requiring:

  • Emergency prescription refills for affected patients

  • Smooth pharmacy transfers for uninterrupted care

  • Compliance with Delaware insurance codes by insurers and Pharmacy Benefit Managers (PBMs)

“We wanted to make sure pharmacies and PBMs follow our code,” said Navarro. “The bulletin provides clear guidance to reduce confusion and protect patients during pharmacy changes.”


Key Actions from the Delaware Board of Pharmacy

To further support patients during this transition:

  • The Delaware Board of Pharmacy has approved one-time emergency refills.

  • These emergency prescriptions are now mandated to be covered by insurance plans.

  • Pharmacies stepping in to serve displaced Rite Aid customers are encouraged to receive fair reimbursement.
